VAWA Overview – Seeking Safety and Independence

The Violence Against Women Act (VAWA) allows certain abused spouses, children, and parents of U.S. citizens or lawful permanent residents to self-petition for lawful permanent residency without the involvement of the abuser.

VAWA provides a pathway for victims of domestic abuse to seek protection, stability, and independence while remaining legally protected within the United States.

Eligibility Requirements for VAWA

Eligibility requirements vary depending on the applicant’s relationship to the abusive individual.

Battered Spouse

  • You are or were married to a U.S. citizen or lawful permanent resident abuser.
  • The marriage ended because of divorce, death, or loss of citizenship within the applicable filing period.
  • You or your child suffered battery or extreme cruelty.
  • The marriage was entered into in good faith and not solely for immigration purposes.
  • You lived with the abusive spouse and can demonstrate good moral character.

Battered Child

  • You are the child of a U.S. citizen or lawful permanent resident abuser.
  • You experienced battery or extreme cruelty by the abusive parent.
  • You resided with the abusive parent.
  • You can demonstrate good moral character when required by law.

Battered Parent

  • You are the parent of a U.S. citizen child who is at least 21 years old.
  • You suffered battery or extreme cruelty by your U.S. citizen child.
  • You resided with the abusive child.
  • You can demonstrate good moral character.

Building a Strong VAWA Case – Evidence & Documentation
