Who is Eligible for an Immigrant Investor Visa?

  • Invest a minimum of $800,000 in a targeted employment area (TEA), such as a rural or high-unemployment area.
  • Establish a new commercial enterprise or acquire an existing enterprise created after the EB-5 program was introduced in 1990.
  • Provide documented evidence proving the investment funds were obtained through lawful means.
  • Maintain an active or “at-risk” investment throughout the required period.
  • Create at least 10 full-time jobs for qualifying U.S. workers, including U.S. citizens and lawful permanent residents.

Applying for an Investor Visa: Step-by-Step Process

Applying for an EB-5 investor visa typically involves the following steps:

  1. Complete and file Form I-526, Immigrant Petition by Alien Entrepreneur.
  2. Ensure all information and supporting documentation are accurate, complete, and properly prepared.
  3. Await petition approval from the U.S. Citizenship and Immigration Services (USCIS). Processing times may vary.
  4. Submit your Green Card application:
    • If applying from outside the United States, file Form DS-260 with the U.S. Department of State.
    • If applying from within the United States, file Form I-485 with USCIS to adjust status.
  5. Prepare for and attend your EB-5 visa interview with a USCIS officer.
